California Probate Code §16061.7 Notification

One of the most important successor trustee duties after death is complying with California Probate Code §16061.7. When a revocable trust or portion of a trust becomes irrevocable because of the settlor’s death, the trustee generally must serve a formal Notification by Trustee on the beneficiaries and heirs specified by California law.

The notification generally must be served within 60 days after the event requiring notification, subject to statutory exceptions. The notice must provide required information about the settlor, trust, trustee, and principal place of trust administration. It must also inform the recipient of the right to request a copy of the trust terms.

Proper service is important because the statutory notice can affect the time period for bringing a trust contest.

When Is a Trust EIN Required?

A separate Employer Identification Number (EIN) is generally required when a revocable living trust becomes irrevocable following the settlor’s death. The IRS specifically identifies this situation as requiring a new EIN. A change in trustee alone generally does not require a new EIN.

Special tax rules can apply to Qualified Revocable Trusts (QRTs), including the possible IRC §645 election. The trustee should determine the trust’s federal tax classification and whether Form 1041 or other tax filings are required.
